8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

9. Indemnity

10. Governing law; venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws, except where preempted by U.S. federal law. You agree that state or federal courts located in Travis County, Texas, shall have exclusive jurisdiction over any dispute arising from these Terms or the Site, and you consent to personal jurisdiction there, unless applicable consumer protection law requires a different forum.

We may modify these Terms at any time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance.
